Federal Judge Orders Freedom of Kilmar Abrego Garcia from Immigration Detention
A court has ordered the prompt release of Kilmar Abrego Garcia from immigration custody, concluding his continued confinement is without lawful basis.
"Since Abrego Garcia's return from wrongful detention in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis wrote in her ruling.
The situation stems from a erroneous deportation to El Salvador in March, which the government later acknowledged was an error. After his return to the United States to answer human smuggling charges, he was held in immigration detention.
In her order, the court noted that the authorities lacks a current removal order, which effectively blocks them from deporting Mr. Abrego Garcia "at this time."
