In 2024, specialists from the federal body for Indigenous peoples journeyed over 100 kilometers through dense rainforest on the southern periphery of the Amazon basin. Their mission was to observe and assist in defending an Indigenous group with little to no interaction with the contemporary society.

Their observations included a small basket made from palm fronds, a child’s footprints by a riverbank, and logs freshly cut to gather honey. They also found abandoned shelters slowly decaying and remnants of foraged food near previous campsites. These were all clear signs that the isolated tribe were present.

Administrative Stalling Block Mandated Defense

Despite a high court order approving a safeguarding strategy for the vulnerable tribe, the national authorities has yet to act. The approved measures included fast-tracking the boundary setting of their ancestral domain and outlining anti-logging strategies.

Red tape, financial shortfalls, and armed disputes over territory—including aggressions by individuals associated with the timber trade—have halted the protection initiative.

Without clearly marked borders, deforestation agents continue to encroach, leaving the Kawahiva extremely vulnerable of genocide. Indigenous supporters label the delay a intentional and deadly violation of the Brazilian law.

Encroaching Deforestation

The proposed vast Indigenous land has yet to receive full protection, as stipulated by law. It is considered the greatest expanse of vulnerable jungle in Brazil that is home to uncontacted Indigenous people.

Money has been a major stumbling block. Initial plans to use federal payments from a road construction fell through. The agency has since looked for alternative funding.

It has now initiated a partnership with a technical academic body. “We have a cooperative agreement that we’ve used successfully before,” explained an official. “The on-ground work is projected to begin in the coming years.”

The institute acknowledged that discussions were progressing but did not provide a timeline.

Complicating everything is what officials term a “highly tense environment in the region,” which is expected to require an security detail during any field operations.

Threats and Intimidation

The threat of violence is real. In previous years, an armed group stormed a government base in the territory, resulting in a violent clash where one attacker was killed. During a subsequent visit, security personnel were stationed in the area.

Recently, an audio recording surfaced in which a man, claiming to be a local leader, verbally attacked the lead field agent. The individual, connected to local loggers, stated to have searched the land “looking for those isolated Indians.”

He is reportedly facing several offenses, including charges related to the attempted murder on the agent. “We can’t work because of this guy,” the man said in the recording.

The Political Clock

Anthropologists and experts point out that it has been over 25 years since the existence of the uncontacted people was documented. “Since then, encroachers have sought to overturn the protective measures in court,” noted one expert.

They raise a concerning idea: that the current delay is a political obstacle rather than a bureaucratic one. This leads to concern that demarcation may not happen even in the coming year.

The political context adds urgency. Many believe that the current term represents the closing window for this territory project to be achieved, before a potential change in government could freeze protective measures, as occurred in the past.

The legal ruling was the result of a petition filed by a national Indigenous organization. The court acknowledged the “threat of elimination, starvation, and assimilation” facing the community.

A lawyer involved described the process as “stalled,” with the court expecting implementation. The dangers of stalling are stark. “Furthermore, it is incredibly perilous and threatens the survival of the isolated Kawahiva,” warned a representative from an campaigning body.
