UK Law Enforcement Agencies Campaign to Use Discriminatory Face Scanning Systems

Law enforcement agencies across the UK effectively campaigned to use a facial recognition system acknowledged as biased against females, young people, and individuals from ethnic minority groups, after complaining that a less biased version generated a reduced number of potential suspects.

How the System Works

UK forces utilize the police national database (PND) to conduct retrospective facial recognition searches. This procedure entails matching a reference photograph of a person of interest against a database of over 19 million custody photos to identify possible hits.

Acknowledged Discrimination

The UK interior ministry conceded last week that the system was biased. This admission followed a study by the National Physical Laboratory (NPL) found it incorrectly matched Black and Asian people and females at much greater frequency than Caucasian males. The Home Office said it “had acted on the findings”.

“It prompts the question of whether facial recognition only becomes effective if users tolerate biases in race and gender. Convenience is a weak argument for overriding fundamental rights.”

Known Issue

Internal documents reveal that this bias has been known about for more than a year. Furthermore, police forces argued to overturn an earlier ruling that was designed to mitigate the problem.

Senior officers were notified of the system's bias in September 2024. The Home Office-commissioned NPL review concluded the system was more likely to suggest incorrect matches for images depicting women, individuals of Black ethnicity, and those aged 40 and under.

A Reversed Decision

In reaction, the national police leadership body mandated that the confidence threshold required for potential matches be increased to a level where the bias was significantly reduced.

However, this directive was overturned the following month after forces complained that the adjusted system was generating fewer “investigative leads”. Internal records indicate the higher threshold cut the proportion of queries resulting in possible identifications from over half to a mere 14%.

Severe Disparities

Although the authorities declined to specify what setting is currently used, the recent independent review discovered the system could produce false positives for women of Black heritage almost 100 times more often than for white women at certain settings.

The Home Office commented on these findings: “Our evaluation found that in a limited set of circumstances the software is more likely to wrongly flag some population segments in its match reports.”

Balancing Utility and Fairness

Describing the effect of the temporary raise to the system's confidence threshold, the NPCC documents state: “The change greatly lessens the impact of discrimination across protected characteristics of ethnicity, generation and gender but had a substantially detrimental effect on police efficiency”. The documents further note that police units argued that “a previously useful tool now delivered results of limited benefit”.

Wider Implementation Proposals

Meanwhile, the government has opened a ten-week public review on its proposals to expand the use of facial recognition technology. The minister for police the relevant minister has described the tool as the “most significant advance since DNA matching”.

Criticism from Advisors and Monitors

The chair of a police oversight board, head of the advisory panel for the national policing equality strategy, commented: “There was scant consideration in race action plan meetings of the technology deployment despite obvious cross-over with the strategy's goals.

“These revelations demonstrate yet again that the anti-racism commitments the police has made through the race action plan are failing to be integrated into broader operations. Independent assessments have cautioned that innovative tools are being implemented in a context where ethnic inequalities, inadequate oversight and faulty information gathering already persist.

“All deployment of this technology must meet strict national standards, be subject to external review, and prove it reduces rather than exacerbates ethnic bias.”

Home Office Response

A government representative said: “The Home Office treat the conclusions of the report with utmost gravity and we have already taken action. A updated software has been independently tested and acquired, which has no statistically significant bias. It will be tested in the coming months and will be undergo evaluation.

“Our priority is ensuring public safety. This revolutionary tool will support officers to apprehend and prosecute offenders. There is human involvement in every step of the procedure and no arrest or charge would be taken without specialist personnel meticulously examining the output.”
